Although a proposal may not require a planning permit, the building permit process may require a variation to the requirements of Part 5 of the Building Regulations 2018. These involve a number of siting matters which encompass town planning considerations including street and side setbacks, site coverage, overlooking and overshadowing.
Applications for single dwellings that seek to vary these requirements require a report and consent from the relevant reporting authority, generally Council’s Municipal Building Surveyor. The reporting authority must have regard to the relevant Minister’s Guidelines.
A town planning consultant is ideally positioned to assist with siting applications given that the Minister’s Guidelines generally defer to town planning considerations including the requirements of the relevant Planning Scheme, and more generally ResCode.
